The Terms of Use of the Site and this Privacy Policy (the “Terms of Use) is intended for all visitors, users and subscribers through a “Midburn Profile” account (the “Site Subscription).

The site makes use of the Masculine form for convenience only but applies to all genders.

This site is owned by Midburn Association (RA) and administered by it (the “Association” and/or “Site Administrator“). The Site is operated for the use of Midburn community members in Israel and abroad, and for any person wishing to receive and be exposed to the information displayed occasionally or continuously.

Any visitor to this site understands and acknowledges that he is subject to the following terms and all applicable laws. By visiting, browsing and registering to it you accept, without limitation and/or qualification, the conditions of these Terms of Use.

Use of this site and its content is solely the user’s responsibility.

The information presented on the site is mostly informative, and made available “As Is” and “As Available”. It is hereby clarified that the relevant conditions for participation in the various Midburn events are detailed in the relevant specific event regulations applying to its ticket buyers.

To the extent such content was published on the site, it was accidental, and upon an application being made to the Site Administrator in such respect, everything made ​​possible and necessary under the circumstances, will be made to remove or replace the content. In any case, the Site Administrator will not be responsible or liable for compensation to anyone considering himself aggrieved thereby.

The presence of links (“Links“) to other websites does not constitute any responsibility by the Site Administrator for the content, reliability, completeness, etc. thereof.

The Site displays content related to Midburn and other world-wide Burning-Man events, where participants tend to implement the principle of Radical Self Expression. Therefore, if you find this content offensive and/or sexual and/or blunt, you should not browse this site.

All intellectual property rights and copyright, if such exist in connection with the Site, are the property of the Association and cannot be copied or used without its permission.

The contents and images that appear on the site are owned and/or licensed and/or under the management of the Site Administrator. It is forbidden to copy or distribute such content or images. Any use thereof other than by this site may harm third parties and is not legal, and the Site Administrator shall not be responsible for any such damage.

Use of such content or images by you or by anyone acting on your behalf is not allowed, unless you have been given an advance written express permission by the Site Administrator. Any unauthorized use of such contents or images may infringe various laws in respect of copyrights, trademarks, privacy protection or any other relevant laws and regulations. Please note that the Site Administrator and/or images or content owners may use any legally available means to strictly protect their proprietary rights, including legal action as required.

Personal Information, Privacy Policy and Confirmation for Receipt of Information

The Association attaches great importance to maintaining the privacy of Site users.

By registering to the Site and opening a “Midburn Profile” account you will be required to provide personal information, such as: your name, address, contact details or e-mail address, etc. Mandatory data will be marked explicitly. Without providing the information required, you will not be able to register, nor open an account. By registering, you confirm that the information you provide is not sensitive and that they will be stored and managed by the Association.

While using the Site additional information may be gathered in respect of your use thereof. The Site Administrator will store the information and will use it or the data you provide at the time of registering in accordance with these Terms of Use or the law provides, for the following purposes:

  • To allow you to use the various Site services, such as purchasing tickets for various Midburn events, forums, and various activities that will be offered from time to time on the Site.
  • To improve and expand the services and content offered on the Site, including creating new services and content corresponding to the requirements and expectations of users of the Site, and to modify, replace or cancel existing services and content. The information used by the Association for this purpose will be mainly statistical information that does not identify you personally.
  • To create personal zones on the Site and/or alternate site and/or in application to be established by the Association, that may include public profiles and communication between users.
  • The Site Administrator may occasionally send you by e-mail information about its services and activities as well as advertising and promotional content. You may request to stop receiving such information at any time.
  • To contact you (if necessary) or to analyze statistical information.
  • For any other purpose, set out in these Terms of Use, or any other binding applicable regulations.
  • For proper operation and development of the Site. To this end, you hereby allow any third parties so authorized by the Site Administrator to obtain this information, subject to safeguarding it in accordance with these Terms of Use.

Site Administrator will not transfer to third parties your personal information and the data collected in respect of your site activity (as such details and information identify you personally), except for in the following cases:

  • If and when you purchase products or services from the Association. In such a case the information it needs to complete the purchase process shall be provided to the Clearing Company.
  • Should you breach these Terms of Use and providing the information will be required in connection thereof or if it the Site Administrator receives a court order instructing it to transfer your details or any information about you to third parties and/or if any dispute, claim, action, demand or legal proceedings, if any, will arise between you and the Association.

 

The Site Administrator is implementing in respect of the Site various systems and procedures for data security. Although such systems and procedures reduce the risk of unauthorized access to its computer systems, they cannot provide absolute certainty. Therefore, the Site Administrator does not guarantee that the Site and/or its services will be absolutely immune from unauthorized access to information stored therein.

 

The Site Administrator reserves the right to use “Cookies” files in order to improve the speed and efficiency of use of content by its users. Each user can choose not to allow the operation of Cookies by making them inoperable in the web browser he uses. However, it should be noted that cancellation of the Cookies’ option can lead to parts of the Site will not be fully operable.

 

Any contact and/or activity established among Site users will be the sole responsibility of the respective users. In no event shall the Site Administrator be responsible whatsoever for any results of such contacts or activities, and without limiting the generality of the foregoing – for any physical, psychological, financial, emotional, or any other damage.

On the Site you will find links that will connect you to other sites, as deemed required by the Site Administrator. Some of these sites may appear under the name and/or brand and/or logo of the Association, but they are not operated and/or administered by the Site Administrator. Therefore, the Site’s Privacy Policy does not apply and/or is not valid on the sites led to by such links. These sites may have their own privacy policy. We encourage you to check and read the privacy policy of any of these sites before you disclose personal and/or other information on such site.

Purchasing tickets through the website

1. Ticketing and use thereof

If you joined the Site by opening a “Midburn Profile” account, you will be able to purchase tickets to various Association events (“Event“)

Tickets will be sold on dates, at prices and in quantity at the Association’s sole discretion.

If you purchased a ticket to an Event via the website, it will be sent to the e-mail address with which you provided for your user account.

In order to make use of the ticket, you will need to print it, and present it together with a valid corresponding ID at the Event’s entrance.

Purchase of Ticket is permitted from age 18 and up.

2. Payment for the ticket

Payment for tickets will be made ​​by credit card only. It is hereby clarified that the payment itself is performed using an external clearing system, operated by an outside company (the “Clearing Company“). Each such purchase shall be subject to the terms of use of the Clearing Company’s site. The association will strive to enter into a clearing agreement with a Clearing Company having the right permit to operate and safe keep databases as required by the Privacy Protection Act 5741-1981 and which adheres to strict security standards (SSL and PCI). The Clearing Company will be solely responsible for safekeeping the sensitive information transferred to it by you.

3. Cancellation of a transaction

A. Cancellation of any transaction is possible in accordance with the Consumer Protection Regulations (cancellation of a transaction), 5771 -2010. It can be affected by a written notice sent by e-mail to the Association, within 14 days from the date of the transaction, provided that the cancellation will be made ​​by no later than 7 Business days prior to the Event.

B. After the cancellation of the transaction, the customer will be entitled to a refund, within 14 days of the cancellation notice being received, and according to the price actually paid, less cancellation fee of 5% of the purchase price. The purchaser and/or anybody on his behalf shall have no claim against the Association for the above deductions.

C. If for any reason the event was cancelled , the ticket purchaser will be entitled to a refund of the payment. If after the start of the event it will be terminated for reasons not dependent of the organizer , the participant shall not be entitled to a refund.

D. If the Event was postponed and rescheduled for a different date, the ticket will be valid for such date. If you will not be able to use the ticket at such date you will have to contact the Association in writing in order to receive a refund.

For the avoidance of doubt, the Site Administrator and/or the Association shall not be liable for any direct, indirect, financial or other damage, caused to you as a result of the purchase of tickets on the site and/or as a result of the cancellation or re-scheduling of an event or rejection and any reliance on the Events occurring on the originally scheduled dates is at your own risk.

Waiver and Release

User hereby declares that he waivers and releases the Association of any responsibility for any damage caused to him and undertakes to bear and/or indemnify it and/or its employees and/or its officers and/or its directors and/or volunteers and/or other users, etc., including but not limited to, for any liability, claim, damage and/or loss (including legal fees), arising due to the use, misuse and/or incorrect use, interruption and/or failure and/or any action prohibited by Computer’s Law, 5755-1995, the Privacy Protection Law, 5741-1981, and/or any other law, made on or through the Site in respect of the information, contents and/or services therein.

Site Administrator and/or any other party involved in its operation in any way, are not responsible for any direct and/or indirect, incidental, consequential and/or punitive damage arising out of visiting the site, and the use thereof and/or its content. Without limiting the foregoing, everything on the Site is provided to you “AS IS” without warranty of any kind, either directly or indirect.

Site Administrator assumes no responsibility, and shall not be liable for any claim for damage to your computer and/or any other item therein and/or viruses that may destroy or disrupt the operation of the computer as a result of your visit at the Site and/or linked sites shown on the Site, as well as any file downloads of material from the Site, including data, text, images, video, audio, etc.

Miscellaneous

Site Administrator does not guarantee continuous availability without interruption and without “hits” on the Site, despite its intention that the website will operate without any disruption. Site Administrator may also stop the availability or use of the Site from time to time for the purpose of its maintenance, re-organization and updating.

Site Administrator reserves the right to make any change to the Site at any time for any reason, without prior notice and without any liability on its part, as well as make changes and/or updates to these Terms of Use. By using this site, you hereby agree to be subject to the provisions of the Terms of Use at any time, and you must get updated as to the changes implemented in respect thereof. If the Terms of Use will undergo ​​significant changes, a notice to this effect will be published on a Site’s Home Page.

The Terms of Use are subject to Israeli law. Jurisdiction in respect thereof is vested in the competent courts in Tel Aviv.
